Terms of Service

1. Eligibility

To use MyReadingStats, you must:

• Be at least 13 years of age. If you are between 13 and 18 years old, you must have the consent of a parent or legal guardian to use the Service.
• Have the legal capacity to enter into a binding contract in your jurisdiction.
• Not be barred from using the Service under applicable law.

By creating an account, you represent and warrant that you meet all of the eligibility requirements above. We reserve the right to terminate accounts of users who do not meet these requirements.

2. Account Registration and Security

Certain features of the Service require you to register for an account. When registering, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to:

• Notify us immediately of any unauthorized use of your account or any other security breach.
• Not share your account credentials with any other person.
• Not create more than one account for the same person.
• Not create an account on behalf of another person without their explicit consent.

We are not liable for any loss or damage arising from your failure to comply with the above requirements. We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being misused.

3. Description of the Service

MyReadingStats provides a platform for book lovers to organize their personal libraries, track reading progress, rate and review books, and visualize their reading statistics through charts and graphics. The Service also includes optional Discord integration, which allows you to share your reviews and reading statistics with your Discord communities.

The Service is accessible through the following platforms:

• The MyReadingStats website, available at myreadingstats.com.
• An HTML5 web application that can be installed and run directly from your browser.
• An Android mobile application, available through the Google Play Store, which currently supports adding books and updating reading progress.

The feature set available may differ between platforms. We reserve the right to add, modify, or remove features from any platform at any time without notice.

4. User-Generated Content

4.1 Your Content

The Service allows you to submit, post, and share content including book reviews, ratings, reading progress entries, and other information ("User Content"). You retain ownership of your User Content.

By submitting User Content to the Service, you grant MyReadingStats a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, display, reproduce, distribute, and adapt your User Content in connection with operating and improving the Service. This license ends when you delete your User Content or close your account, except where your content has been shared publicly and copied by others.

4.2 Content Standards

You agree not to post User Content that:

• Is false, misleading, or defamatory.
• Is obscene, offensive, or otherwise objectionable.
• Infringes any third party's intellectual property, privacy, or other rights.
• Contains spam, unsolicited advertising, or promotional material.
• Violates any applicable law or regulation.

We reserve the right (but have no obligation) to review, remove, or modify any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You may not:

• Attempt to gain unauthorized access to any part of the Service, other accounts, or any systems or networks connected to the Service.
• Use automated tools, bots, or scrapers to collect data from the Service without our prior written consent.
• Interfere with, disrupt, or place an unreasonable load on the infrastructure or servers supporting the Service.
• Use the Service to transmit malware, viruses, or any other harmful code.
• Attempt to reverse engineer, decompile, or disassemble any portion of the Service.
• Use the Service in any way that could damage our reputation or that of other users.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

We reserve the right to investigate violations of this policy and may involve law enforcement authorities where appropriate.

6. Intellectual Property

All content, features, and functionality of the Service — including but not limited to the design, graphics, text, logos, software, and underlying source code — are the exclusive property of APEX Studio and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without our prior written consent.

Book metadata such as titles, author names, cover images, and descriptions may be sourced from third-party databases. We do not claim ownership over such third-party content.

7. Third-Party Services and Integrations

7.1 Discord Integration

The Service offers optional integration with Discord, a third-party communications platform, to allow you to share your reading reviews and statistics. Your use of Discord is governed by Discord's own Terms of Service and Privacy Policy, and we are not responsible for Discord's practices, availability, or any content shared through that platform.

You are solely responsible for ensuring that any content you share via the Discord integration complies with Discord's community guidelines and applicable laws.

7.2 Android Application

The Android application is distributed through the Google Play Store and is subject to Google's terms and policies in addition to these Terms. The Android app integrates with the MyReadingStats website backend and your use of the app is also governed by these Terms.

7.3 Other Third-Party Services

The Service may contain links to or integrate with third-party websites, services, or APIs. We do not endorse or assume any responsibility for any third-party services. Your interactions with any third-party service are solely between you and that third party.

8. Infrastructure and Service Availability

The Service is hosted on cloud infrastructure provided by a third-party cloud provider. While we strive to maintain a reliable and high-quality service, we do not guarantee that the Service will be available at all times. The Service may be temporarily unavailable due to maintenance, updates, infrastructure issues, or circumstances outside our control.

We are not liable for any loss or inconvenience arising from service interruptions or downtime.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection, use, and sharing of your information as described in the Privacy Policy. We encourage you to review our Privacy Policy carefully before using the Service.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

We do not warrant the accuracy, completeness, or reliability of any book data, user reviews, or other content available through the Service.

11. Limitation of Liability

To the fullest extent permitted by applicable law, APEX Studio, its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of or inability to use the Service.

In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability shall be limited to the maximum extent permitted by applicable law.

12. Termination

You may close your account at any time by contacting us or using account settings within the Service. Upon account closure, your profile and associated User Content may be deleted in accordance with our Privacy Policy.

We reserve the right to suspend or permanently terminate your account, without notice, if we reasonably believe you have violated these Terms, engaged in abusive behavior, or pose a risk to the Service or other users. We may also discontinue the Service, or any part of it, at any time.

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property rights, disclaimers, and limitations of liability.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective date" at the top of this page. For material changes, we will provide notice through the Service (such as a banner notification) or by other means, such as email if you have provided one.

Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must stop using the Service.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to conflict-of-law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Netherlands.

Before initiating any formal legal proceedings, you agree to first contact us to attempt to resolve the dispute informally. We will endeavor to respond to such requests within 30 days.

15. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and APEX Studio regarding your use of the Service and supersede any prior agreements. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
